COMPETITION RULES FOR ARC ARTIST AWARDS 2022

AMATEUR AND PROFESSIONAL CATEGORIES

TERMS AND CONDITIONS FOR PARTICIPATION

 

The Arc Artist Awards 2022 is a Competition to find the best professional and amateur makeup artists in South Africa (“the Competition”) and is promoted by Mistragystix (Pty) Ltd trading as Arc Stores (“the Promoter”).

 

2. By entering into the Competition, all participants agree to be bound by these Rules/Terms and Conditions (hereinafter referred to as “the Rules”).

 

3. Eligibility

3.1. Participants are eligible to enter the Competition if they –

3.1.1. Are over the age of eighteen years old;

3.1.2. Are citizens of the Republic of South Africa and reside in South Africa;

3.1.3. Make themselves available for a workshop/challenge on the 10th of February 2022; and

3.1.4. Make themselves available for the awards ceremony event in March 2022.

3.2. Participants must –

3.2.1. ensure their availability to travel to Cape Town and/or Johannesburg during the months of February – March 2022, as may be required by the Promoter;

3.2.2. not be contracted to any makeup artist school or agency.

3.3. All participants who meet the eligibility requirements set out above will be automatically entered into the Competition. Only one entry per participant is permitted.

3.4. The following persons and entities are not eligible to participate in the Competition:

3.4.1. directors, members, partners, employees, agents of or consultants to the Promoter, its subsidiaries, divisions and/or associated companies; or

3.4.2. any other person who directly or indirectly controls or is controlled by the Promoter, and their spouses, life partners, immediate family members and business partners.

4. Entry

4.1. Entries open on 20 December 2021 and close on 31 January 2022.

4.2. Participants eligible to enter the Competition in the amateur category must –

4.2.1. Submit an entry through the Promoter’s social media channels using the handle “@arcstoreofficial” and the hashtag “#ARCartist” consisting of a thirty second Reel or TikTok video where they show the creation of the look;

4.2.2. Not have earned a professional certificate in makeup artistry;

4.2.3. Not have had a paid, professional career in makeup artistry.

4.3. Participants eligible to enter the Competition in the professional category must –

4.3.1. Submit an entry consisting of an editorial or image created by the participant that represents “modern beauty” to marketing@artcstore.co.za. The entry must include four clear, colour jpg or png images that are two megabites or less in size. The image must be a head and shoulders front view and include a subject line “ARC ARTIST ENTRY” and the participant’s name. The entry must include a 100 word motivation of the participant’s makeup style, their experience and career highlights;

4.3.2. Have an established career of at least three years as a professional makeup artist;

4.3.3. Show evidence of having worked on a professional television, photographic or film set or in a professional environment such as wedding and runway shows.

4.4. Entries must NOT include any nudity.

4.5. The Judges will evaluate the entries and will select the ‘top ten’ participants from the eligible entries received. The top 7 (seven) participants will be advised of their place in the top 7 (seven) by the 11th of February 2022. The judges’ decision is final and no correspondence or communication regarding the judges’ decision will be entered into.

4.6. The top 7 (seven) participants will be announced on all social media platforms.

4.7. The top 7 (seven) participants are required to showcase their skills and talents in a workshop/challenge held on the 10th of February 2022.

4.8. The Promoter will host an exhibition in stores, nationwide, of the top 7 (seven) participants on 21 February 2022.

4.9. The participants are required to attend an awards ceremony event in March 2022 where the prize winners will be announced in the amateur and professional categories.

4.10. Entries that are unclear, illegible or contain errors will be declared invalid and disqualified from participation in the Competition.

 

5. Panel of Judges

5.1. The panel of judges are independent persons selected by the Promoter.

5.2. The judges are not directors, members, partners, employers, agent or consultants of or any other person who directly or indirectly controls or is controlled by the Promoter or marketing service providers or spouses, life partners, business partners or immediate family members of the Promoter or marketing service providers.

5.3. The judges shall exercise their expertise in makeup, fashion and beauty to determine the prize winners. Prize winners will be determined by the level of skill portrayed by them in their Competition entry and at the workshop event held where the prize winners were required to re-create their look.

 

6. Prizes

6.1. The prize winner in the amateur category will be eligible to win –

6.1.1. A full makeup kit;

6.1.2. A sponsored professional makeup course; and

6.1.3. An Arc Artist Card which entitles the prize winner to a 15% discount on all makeup purchased in the Promoter’s stores and online.

6.2. The prize winner in the professional category will be eligible to win –

6.2.1. A full makeup kit;

6.2.2. An invitation to work on a paid for campaign of the Promoter;

6.2.3. Hosting a masterclass in every store (nation-wide) of the Promoter;

6.2.4. A session hosted by Huda Kattan; and

6.2.5. An Arc Artist Card which entitles the prize winner to a 15% discount on all makeup purchased in the Promoter’s stores and online.

6.3. Prizes are not transferable and cannot be exchanged for cash or for any other item. If, for any reason, the Promoter cannot provide any of the prizes, the Promoter will award an alternative prize of a similar value.

6.4. The prize winners contact details will be obtained directly from the participant, or their representative nominated by them in writing. In the event of the prize winner not being present at the award ceremony, the prize winner will be notified of their success by way of telephone call within one week of the announcement being made.

6.5. The Promoter reserves the right to declare a prize forfeited and to select another prize winner if, within two weeks of having announced the prize winner, the prize winner cannot be successfully contacted.

6.6. The Promoter reserves the right to disqualify prize winners if they do not accept, in writing, the prize and winning title of the Competition within two business days of being requested to do so. In such event, the Promoter will be entitled to select another winner within one business day thereafter. The prize winners’ names will be published on the Promoter’s website at www.arcstore.co.za and may or may not be published in external magazines and the Promoter’s social media and communication channels.

6.7. The prize winners must be available to endorse the Promoter and its brands exclusively for one year.

 

7. Consent

7.1. The Participant hereby acknowledges their rights in terms of Regulation 11(3) of the Regulations to the Consumer Protection Act to decline an invitation to permit the use of their image in marketing material, participate in marketing activities and be present at the announcement of prize winners.

7.2. By entering into this Competition, the participant has waived the exercise their rights of refusal as per Regulation 11(3).

7.3. In addition to the waiver, the participant hereby agrees to appear on the Promoter’s promotional platforms which include, without limitation, television, the internet, posters, leaflets, radio, magazines and/or the Promoter’s social media platforms.

7.4. The participant therefore gives their consent for their image to be used in marketing material and participation in marketing activities as per the schedule of appearances required by the Promoter.

7.5. No compensation will be payable for the use of the prize winner’s appearances, participation in marketing material and/or activities.

 

8. Limitation of Liability

8.1. The Promoter accepts no responsibility for:

8.1.1. Lost entries;

8.1.2. The prize winner providing the Promoter with incorrect details; or

8.1.3. Any error, omission or technical failure relating to the Competition.

8.2. The Promoter will not be liable to any participant or any third party for any harm, losses, damages, costs, claims, injuries or death in connection with their entry into the Competition.

8.3. Entries into the Competition are solely at the risk of the participant.

8.4. By participating in the Competition, the participant agrees that neither the Promoter or its partners nor any of their respective advertising agencies will be liable for any losses, damages, costs or claims in connection with the Competition or resulting from acceptance, possession, or use of any prize.

8.5. The Promoter reserves the right to terminate, suspend or amend the Competition, as well as the Rules, for any reason whatsoever. The Promoter and its services providers, including any telephone network providers, are not responsible for incorrect or inaccurate transcription of entry information, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online services or for any other error.

 

9. General

9.1. The participant hereby acknowledges and agrees that –

9.1.1. entry into the Competition is taken entirely at their own risk and by entering the Competition the participant agrees to accept further communication from the Promoter regarding aspects related to the Competition and prizes;

9.1.2. the participant is the owner or is otherwise in control of all the rights to the content posted on social media;

9.1.3. the content and information submitted by the participant is their own and is accurate and that the participant hereby indemnifies the Promoter and holds the Promoter harmless for all claims resulting from content posted by the participant;

9.1.4. the Promoter has the right, but not the obligation, to regulate and edit or remove any activity or content posted by the participant on social media relating to the Competition. The Promoter and/or its partners take no responsibility and assume no liability for any materials posted by the participant or any third party.

9.1.5. all images submitted as entries into the Competition will become and remain the property of the Promoter. Images may be used commercially to advertise the Competition with the Promoter and partners as its sponsors, as well as distributed, without credit or payment, across digital and print platforms. This applies to additional content generated via any photo-shoots.

9.2. Personal information provided by the participant will only be used by the Promoter for the purposes of the Competition.

9.3. Prize winners will not receive any salary or other form of income from the Promoter or the Competition, in-store activations or webinars relating to the Competition.

9.4. The Promoter will not be responsible for any loss of income should the participant not be able to obtain leave from their current employer for travel purposes.

9.5. Prize winners may not post, send or share any photographs relating to the Competition or the Promoter prior to promotional material being distributed by the Promoter.

9.6. The participants are entitled to bring a companion with them to the exhibitions and/or award ceremonies, at their own expense. The Promoter will not be responsible for any losses, damages or costs sustained or claims arising by participants and/or their companions resulting from any travel or photo-shoot events.

9.7. In the event of the participant’s companion being under the age of 18 years, it is such participant’s responsibility to ensure that the minor is taken care of in every aspect and not left unattended.

9.8. The top ten participants will be required to provide the Promoter with proof of identification in the form of a valid identity document, passport or South African driver’s licence.

9.9. A copy of these Rules/Terms and Conditions will be available on the Promoter’s website at www.arcstore.co.za.
